There shouldn't be a roll-off. The spell supercedes the rules of the character. Thats like saying a character gets an Armour save if the armour is said to be on him even if a spell says he doesn't get one.

I concur with tacklbry. As it is a template effect, you would use the look-out sir rule. If he fails it, roll him separately for wounding.

From the way I read it, it sound more like a regimental city list. I see executioners being more available in cities than shades, so I voted thus.
